By accessing or using the HugMe application and related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.
Service Description
HugMe is an AI-powered emotional companion designed to provide supportive conversations, emotional reflection, and a non-judgmental listening experience. The Service is not a substitute for professional mental health treatment, therapy, or medical advice. If you are experiencing a mental health crisis, please contact a qualified healthcare professional or emergency services immediately.
User Conduct
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not use the Service to harass, abuse, or harm others, distribute harmful or malicious content, attempt to reverse-engineer or exploit the underlying AI systems, impersonate any person or entity, or violate any applicable local, state, national, or international law. We reserve the right to suspend or terminate your access if we determine, in our sole discretion, that you have violated these Terms.
Intellectual Property
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, software, and underlying AI models, are the exclusive property of HugMe or its licensors and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of any content you submit through the Service, but grant us a limited license to use it solely for the purpose of providing and improving the Service.
Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. The AI companion may occasionally produce inaccurate or inappropriate responses.
Limitation of Liability
To the maximum extent permitted by applicable law, HugMe and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claims arising under these Terms shall not exceed the amount you paid to us in the twelve months preceding the claim.
Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. You may delete your account at any time through the app settings. Provisions of these Terms that by their nature should survive termination shall remain in effect, including ownership, disclaimers, and limitations of liability.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in San Francisco County, California.
